NEXUS BuildCo Referral Programme – Terms & Conditions

1. Introduction

These Terms and Conditions (“Ts&Cs”) govern participation in the NEXUS BuildCo Referral Programme (“the Programme”). By participating, you agree to be bound by these Ts&Cs.

2. Definitions

For the purposes of this Programme:

• “NEXUS BuildCo” refers to NEXUS BuildCo (Pty) Ltd.

• “Referrer” refers to any individual or business submitting a referral.

• “Referred Client” refers to the person or entity introduced to NEXUS BuildCo by the Referrer.

• “Referral” refers to a new potential client submitted to NEXUS BuildCo.

• “Project Value” refers to the total amount actually paid by the Referred Client to NEXUS BuildCo for completed work.

• “Successful Referral” means a referral that results in a completed project where full and final payment has been received by NEXUS BuildCo.

3. Eligibility

• The Programme is open to any individual or business.

• There is no limit to the number of referrals a Referrer may submit.

• Employees or direct affiliates of NEXUS BuildCo may be excluded at the company’s discretion.

4. How the Programme Works

• Referrals must be submitted through NEXUS BuildCo’s official referral channel.

• The Referred Client must be new to NEXUS BuildCo.

• A referral will not qualify if:

  • NEXUS BuildCo was already aware of the lead

  • The client has already been contacted or quoted

  • The project has already commenced

• Only the first Referrer of a specific client will be eligible for a referral fee.

5. Referral Fee Structure

• The Referrer will earn 2% of the total Project Value.

• Minimum payout: R500 per successful referral

• Maximum payout: R50,000 per successful referral

6. When a Referral is Considered Successful

A referral will only be deemed successful when:

• The project has been fully completed, and

• NEXUS BuildCo has received full and final payment from the Referred Client.

7. Payment Terms

• Referral fees are payable only after full payment has been received from the Referred Client.

• No payment will be made if:

  • The client has any outstanding or unpaid balances

  • The project is cancelled or does not proceed

• In cases where:

  • The scope of work is reduced, or

  • The project value changes

  The referral fee will be calculated based on the actual amount paid by the client.

• Payments will be made via Electronic Funds Transfer (EFT) into a valid South African bank account.

• Referrers may be required to provide:

  • Valid banking details

  • Identification and/or business documentation

  • An invoice (for businesses)

8. Exclusions

The following will not qualify as Successful Referrals:

• Existing or previous clients of NEXUS BuildCo

• Duplicate referrals

• Self-referrals

• Projects that are cancelled or indefinitely delayed

• Projects where payment is not fully received

9. Referral Validity

• A referral remains valid for a period determined at NEXUS BuildCo’s discretion.

• NEXUS BuildCo reserves the right to reassess eligibility if there is a significant delay between referral submission and project commencement.

10. Fraud and Abuse

• Any fraudulent, misleading, or abusive behaviour (including submitting false or non-consensual referrals) will result in disqualification.

• NEXUS BuildCo reserves the right to withhold or cancel any referral payment where abuse is suspected.

11. Protection of Personal Information (POPIA)

• By submitting a referral, the Referrer confirms that they have obtained consent from the Referred Client to share their personal information.

• NEXUS BuildCo will process personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA).

• Personal information will only be used for purposes related to the referral and project engagement.

12. Limitation of Liability

NEXUS BuildCo shall not be liable for:

• Any indirect, incidental, or consequential damages arising from participation in the Programme

• Any delays in payment outside of its reasonable control

13. Right to Amend or Terminate

• NEXUS BuildCo reserves the right to modify, suspend, or terminate the Programme at any time without prior notice.

• Any changes will not affect referral fees already earned in accordance with these Ts&Cs.

14. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.
